Terms of sales
Article 1 – This contract concerns the rental of furnished accommodation at Pierres Dorées located at 17 rue Lapicque 69620 Theizé.
Article 2 – length of stay: The tenant signing this contract concluded for a fixed period may not under any circumstances invoke any right to remain in the premises at the end of the stay.
Article 3 – conclusion of the contract: The reservation becomes effective once the tenant has sent the owner the sums due.
The rental concluded between the parties to this deed may in no case benefit even partially to third parties, natural or legal persons, except with the written consent of the owner. Any violation of this last paragraph would be likely to result in the immediate termination of the rental at the fault of the tenant, the rental income remaining definitively acquired by the owner.
Article 4 – Cancellation of the rental of a furnished apartment by the tenant: Any cancellation must be communicated to the owner with acknowledgment of receipt.
a) Cancellation before arrival at the site:
· More than 30 days prior to arrival: Renter will be issued a full refund minus bank charges
· Between 30 and 14 days before arrival: 45% will be refunded to the renter
· Between 13 days and 8 days before arrival: 20% will be refunded to the tenant
· There will be no refund within 7 days.
b) If the stay is shortened, the rental price remains with the owner. Therefore, no refund will be made.
c) Covid: If the stay is canceled due to contamination of one of the Covid participants, the tenant will be issued a nominative credit for the amount paid, valid for 6 months
Article 5 – Cancellation of the rental of the furnished apartment by the owner: The owner pays the tenant all of the sums paid in advance.
Article 6 – arrival: The tenant must arrive on the day specified in the time slot mentioned on this contract, namely between 4 p.m. and 8 p.m. In the event of late or delayed arrival, the tenant must notify the owner.
Article 7 – exit: The tenant must vacate the accommodation by 10:30 am at the latest. Any exceeding of the schedule will be subject to compensation of 15 euros per half hour exceeded.
Article 8 – additional services canceled by the owner. The rental of bicycles, hiking … may for reasons of force majeure (weather, illness …) be canceled by the owner.
In the event of cancellation by the owner, a nominative credit note valid for 6 months, equivalent to the amount of the service will be issued.
Article 9 – inventory: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure from the room. This inventory constitutes the only reference in the event of a dispute concerning the inventory of fixtures.
The state of cleanliness of the rooms on arrival of the tenant must be noted in the inventory. The kitchenette and in particular the fridge, the hotplates and the oven must be left clean as well as the dishes washed and put away.
The cleaning of the premises is intended for normal use. In the event of abnormal use of the premises, or exceptional soiling, an excess of cleaning costs (at least 30 euros) will be re-invoiced to the tenant.
Article 10 – security deposit or deposit: On arrival of the tenant, a security deposit is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned within a maximum of 7 days to the tenant, less the cost of repairing the premises if damage was observed.
In the event of early departure (prior to the time mentioned on this contract) preventing the establishment of the inventory on the same day of the tenant’s departure, the security deposit is returned by the owner within a period not exceeding not a week.
Article 11 – Use of the premises: The tenant must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.
Article 12 – capacity: This contract is established for a maximum capacity of 2 people per apartment. If the number of tenants exceeds the capacity of reception, the owner can refuse the additional people. Any modification or termination of the contract will be considered at the initiative of the customer.
Article 13 – animals: Animals are not allowed.
Article 14 – Insurance: The tenant is responsible for all damages resulting from his doing. He is therefore required to be insured.
Article 15 – payment of charges: Water and electricity charges are included in the rental price, for normal use. In the event of abnormal use, the charges may be re-invoiced to the tenant.
Article 16 – disputes: Any complaint relating to the rental will be dealt with by the competent court.
